What is a delinquency notice?

A notice of delinquency is not a letter any parent wants to receive. It is a legal notification that one has an overdue payment for a court-ordered child support agreement or other such financial obligation.

What does it mean when your loan is delinquent?

Delinquency means that you are behind on payments. Once you are delinquent for a certain period of time (usually nine months for federal loans), your lender will declare the loan to be in default. The entire loan balance will become due at that time.

What does serious delinquency mean?

A serious delinquency is when a single-family mortgage is 90 days or more past due and the bank considers the mortgage in danger of default. Once a mortgage is in default, a lender typically initiates foreclosure proceedings.

What happens when a court orders spousal support?

In every case ordering spousal or partner support, the court will order that an earnings assignment (also called “wage garnishment”) be issued and served. The earnings assignment tells the employer of the person ordered to pay support to take the support payments out that person’s wages.

When to deduct spousal support from child support?

If your former spouse or partner also has a child support earnings assignment in place, child support is deducted first. Spousal or partner support assignments come after child support earnings assignments.

What to do if your spouse is not getting child support?

Spousal or partner support assignments come after child support earnings assignments. If the local child support agency (LCSA) is involved in your case, the LCSA will automatically issue an earnings assignment and begin collecting from your former spouse or domestic partner’s employer.
