When does OWCP reduce your workers’compensation benefits?

If the rehabilitation counselor deems the employee capable of working any job, the OWCP will accordingly reduce the employee’s workers’ compensation wage loss benefit. If you are instructed to participate in the OWCP vocational rehabilitation program, you must participate or the OWCP has the right to completely terminate your wage-loss benefit.

Can a ” probably ” claim be supported by OWCP?

A: “Probably” is speculative and not acceptable to OWCP. A claim must be supported by medical evidence that clearly shows that the employee’s medical condition is causally related to the employment factors identified as the basis of the claim.

How does OWCP decide whether new merit decision?

When all evidence has been reviewed, OWCP will issue a new merit decision, based on all the evidence in the record. A copy of the decision will be provided to the agency. (c) An employee dissatisfied with this new merit decision may again request reconsideration under this subpart or appeal to the ECAB.
