What happens when you file an OWCP claim?
If you are injured on the job, you file a claim form through your employing agency to start your case. You may be entitled to receive medical care, lost wages, and a schedule award. There is no time limitation on how long you can receive benefits. OWCP’s job is to return you to the work force.

You can NOT continue to receive OWCP wage loss benefits, while also earning federal disability retirement annuity You CAN receive an OWCP schedule award (pay for a statutory number of weeks based on which body parts are disabled) in conjunction with federal disability retirement annuity

When does OWCP reduce your workers’compensation benefits?
If the rehabilitation counselor deems the employee capable of working any job, the OWCP will accordingly reduce the employee’s workers’ compensation wage loss benefit. If you are instructed to participate in the OWCP vocational rehabilitation program, you must participate or the OWCP has the right to completely terminate your wage-loss benefit.

Where does OWCP send copies of psychiatric reports?
Based on your written request, OWCP will send a copy to you or to your authorized representative (in certain cases, such as a psychiatric report, OWCP will only send the copy to your representative or your attending physician).
Can a postal service employee prosecute an OWCP case?
As the result of an agreement between OWCP and the Postal Service, the Postal Service has been given the right to accept assignments of the right to prosecute.
How does OWCP decide whether new evidence or argument?
When application for reconsideration is granted, OWCP will review the decision for which reconsideration is sought on the merits and determine whether the new evidence or argument requires modification of the prior decision.
Can a ” probably ” claim be supported by OWCP?
A: “Probably” is speculative and not acceptable to OWCP. A claim must be supported by medical evidence that clearly shows that the employee’s medical condition is causally related to the employment factors identified as the basis of the claim.
How does OWCP decide whether new merit decision?
When all evidence has been reviewed, OWCP will issue a new merit decision, based on all the evidence in the record. A copy of the decision will be provided to the agency. (c) An employee dissatisfied with this new merit decision may again request reconsideration under this subpart or appeal to the ECAB.

To assist claimants seeking medical services, OWCP has an on-line listing of providers, by program that is searchable by: specialty, name, city, state, and zip code. Customers will be advised that a provider listing is not an endorsement, referral, or an agreement to reimburse for medical services rendered by the Department of Labor or OWCP.
